Welcome to Auvella. These Terms of Service (“Terms”) govern your access to and use of auvellashop.com (the “Site”), including all purchases, memberships, features, content, and services offered through the Site.

The Site is operated by KINGSNAKE MARKETING LLC, doing business as Auvella. Throughout these Terms, “Auvella,” “we,” “us,” and “our” refer to KINGSNAKE MARKETING LLC.

By visiting the Site, placing an order, joining the Auvella VIP Club, or otherwise using our services, you agree to be bound by these Terms, together with our Privacy Policy, Refund Policy, Shipping Policy, and any other policies published on the Site.

1. Eligibility and Acceptance

You must be at least 18 years old or the age of majority in your place of residence to make a purchase or enroll in a paid membership through the Site.

By using the Site, you represent that the information you provide is accurate, current, and complete and that you have the legal authority to use your selected payment method.

You may not use our products, Site, or services for any unlawful, fraudulent, abusive, or unauthorized purpose.

2. Products and Product Information

Auvella offers a curated selection of jewelry, necklaces, earrings, hair accessories, jewelry organizers, and related fashion accessories.

We make reasonable efforts to display product descriptions, measurements, materials, colors, finishes, photographs, and prices accurately. However:

  • Colors and finishes may appear differently depending on lighting, photography, and device settings.
  • Measurements may vary slightly.
  • Product packaging may change without notice.
  • Natural-looking stones, patterns, textures, and decorative finishes may differ slightly between individual items.

We reserve the right to correct errors, update product information, modify prices, or discontinue products at any time without prior notice.

3. Orders and Order Acceptance

Submitting an order does not guarantee acceptance. We may refuse, limit, cancel, or place an order under review when reasonably necessary, including in cases involving:

  • Suspected fraud or unauthorized payment activity;
  • Incorrect product or pricing information;
  • Product unavailability;
  • Shipping restrictions;
  • Unusually large quantities;
  • Misuse of promotions, discounts, or VIP pricing.

If we cancel an order after payment has been processed, we will issue a refund to the original payment method for the canceled amount.

We may limit quantities purchased per customer, household, payment method, billing address, or shipping address.

4. Pricing, Taxes, and Payment

Unless otherwise stated, all prices displayed on the Site are in United States dollars (USD).

Prices may change at any time. The price applicable to an order is the price displayed and confirmed during checkout, subject to correction of obvious errors.

Shipping charges, applicable taxes, membership fees, and any other charges will be disclosed before the order is completed.

You authorize us and our payment service providers to charge your selected payment method for all amounts shown during checkout.

Your order may be delayed or canceled if payment authorization is declined, reversed, disputed, or flagged for review.

5. Guest and VIP Pricing

Certain products may display two purchasing options:

  • VIP Price: A discounted price available in connection with enrollment in or maintenance of an active Auvella VIP Club membership.
  • Guest Price: The regular purchase price available without joining the Auvella VIP Club.

Selecting the VIP Price means that you are choosing both:

  1. The applicable product at its displayed VIP price; and
  2. Enrollment in the Auvella VIP Club under the recurring billing terms disclosed before checkout.

VIP pricing is not a standalone promotional discount. It is a membership benefit associated with an active recurring membership.

Customers who do not wish to enroll may purchase eligible products using the displayed Guest Price.

6. Auvella VIP Club Membership

The Auvella VIP Club is a recurring membership program that provides access to member pricing, selected offers, and other benefits described on the Site.

Unless a different amount or promotional offer is clearly displayed before purchase, the membership fee is:

$39.95 per month

The timing of the initial membership charge, any introductory period, and the recurring billing date will be clearly displayed during the purchase process.

By enrolling, you authorize Auvella and its payment processors to charge the membership fee automatically to your selected payment method at the disclosed billing interval until the membership is canceled.

Membership benefits:

  • Are personal to the registered customer;
  • May not be transferred, resold, or shared for commercial use;
  • May change as the program evolves;
  • Remain available only while the membership is active and in good standing.

7. Automatic Renewal and Cancellation

Your Auvella VIP Club membership automatically renews at the disclosed billing interval until canceled.

You may cancel before your next scheduled billing date through the available Membership Cancellation page, customer account tools, or by contacting:

Cancellation stops future recurring membership charges. Unless otherwise stated during cancellation, your membership benefits may remain available through the end of the billing period already paid for.

Canceling a membership does not automatically cancel or refund product orders that have already been placed.

Membership charges already processed are generally non-refundable, except when required by applicable law, caused by an error on our part, or otherwise stated in our applicable Refund or Membership Cancellation Policy.

You are responsible for submitting a cancellation request before the next scheduled billing date.

8. Changes to Membership Terms

We may modify membership benefits, pricing, or program terms from time to time.

When required by applicable law, we will provide advance notice of a material change to the membership fee or recurring billing terms. Any updated fee will apply only to future billing periods after the applicable notice.

You may cancel the membership before an updated fee takes effect.

9. Shipping and Delivery

Shipping methods, estimated processing times, estimated delivery windows, and applicable charges are described in our Shipping Policy and during checkout.

Delivery estimates are not guarantees. Delays may occur because of carrier operations, customs processing, weather, holidays, address issues, inventory availability, or other circumstances outside our reasonable control.

Customers are responsible for providing a complete and accurate shipping address. Please contact us promptly if you notice an address error.

Additional terms concerning lost, delayed, returned, or damaged shipments are available in our Shipping Policy.

10. Returns and Refunds

Product returns, exchanges, damaged-item claims, cancellations, and refunds are governed by our Refund Policy.

Returned products must satisfy the eligibility requirements and deadlines stated in that policy.

Product refunds do not automatically include:

  • Original shipping charges;
  • Return shipping costs;
  • Membership charges;
  • Charges unrelated to the returned item.

Nothing in these Terms limits any non-waivable consumer rights available under applicable law.

11. Jewelry and Accessory Care

Our jewelry and accessories are intended for external decorative use.

Exposure to water, moisture, perfumes, cosmetics, cleaning products, sweat, salt, chlorine, or improper storage may affect the appearance or longevity of certain finishes and materials.

Individual sensitivities to metals, coatings, adhesives, stones, or other materials may vary. Customers with known allergies or significant skin sensitivities should review available material information before use and consult a qualified professional when appropriate.

Discontinue use if irritation or discomfort occurs.

Our products are not intended to diagnose, treat, cure, or prevent any medical or dermatological condition.

Small products and detachable components should be kept away from young children and pets.

12. Intellectual Property

All content appearing on the Site, including the Auvella name, logos, product names, photographs, graphics, written content, page layouts, designs, and other materials, is owned by or licensed to KINGSNAKE MARKETING LLC and is protected by applicable intellectual property laws.

You may use the Site only for personal, non-commercial shopping purposes.

You may not copy, reproduce, modify, publish, distribute, sell, scrape, exploit, or commercially use Site content without our prior written authorization.

13. Prohibited Activities

You may not:

  • Use the Site for fraudulent or unlawful activity;
  • Submit false payment, identity, billing, or shipping information;
  • Attempt to interfere with the Site’s security or operation;
  • Introduce malware, malicious code, or automated attacks;
  • Access another customer’s account without authorization;
  • Scrape, copy, or harvest Site content or customer information;
  • Abuse discounts, promotional offers, chargebacks, or membership benefits;

We may suspend or terminate access when we reasonably believe these Terms have been violated.

Those services may be governed by their own terms and privacy policies. We are not responsible for the independent content, security, availability, or conduct of third-party websites or services, except to the extent required by applicable law.

15. Disclaimer of Warranties

To the fullest extent permitted by law, the Site and its content are provided on an “as available” and “as is” basis.

We do not guarantee that the Site will always be uninterrupted, error-free, secure, or available at all times.

This section does not exclude any express product promise made by Auvella or any warranty or consumer protection that cannot legally be excluded.

16. Limitation of Liability

To the fullest extent permitted by applicable law, KINGSNAKE MARKETING LLC and its officers, employees, contractors, affiliates, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from the use of the Site, membership program, or products.

Where liability cannot legally be excluded, our liability will be limited only to the extent permitted by applicable law.

Nothing in these Terms excludes liability that cannot lawfully be limited, including applicable statutory consumer rights.

17. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless KINGSNAKE MARKETING LLC and its affiliates, officers, employees, contractors, and service providers from claims, liabilities, damages, or expenses arising from:

  • Your unlawful use of the Site;
  • Your violation of these Terms;
  • Your infringement of another party’s rights;
  • Fraudulent or unauthorized conduct attributable to you.

By using the Site, you acknowledge that online transactions require the collection and processing of information such as contact details, billing information, shipping information, order history, and account data.

By placing an order, creating an account, or contacting us electronically, you consent to receive transactional communications relating to your purchases, account, membership, billing, shipping, cancellation requests, and customer support.

Marketing communications are subject to the preferences and opt-out options provided in those messages.

These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-law principles.

Subject to any mandatory consumer rights that apply in your jurisdiction, disputes relating to these Terms or the Site will be brought before a court of competent jurisdiction in Wyoming.

Before filing a formal claim, we encourage customers to contact us so that we have a reasonable opportunity to investigate and resolve the matter.

21. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision will be enforced to the greatest extent legally permitted, and the remaining provisions will continue in effect.

22. No Waiver

Our failure to enforce any provision of these Terms does not waive our right to enforce that provision or any other provision later.

We may update these Terms to reflect changes to our products, membership program, business practices, technologies, or legal obligations.

Updated Terms will be posted on this page with a revised “Last Updated” date. Your continued use of the Site after an update constitutes acceptance of the revised Terms to the extent permitted by law.

Material changes affecting recurring membership billing will be communicated as required by applicable law.
